In the event that you discover you have purchased a counterfeit Moncler item, there are a few steps that can be taken to get your money back:

Fakes purchased on ebay :

ebay allows purchases for items "not as described" to be returned within 30 days of receipt of the item. Their customer service tends to always favor the buyer, so if you find you have purchased a fake off ebay, only a few steps need to be taken to get the return/refund process started.

There is no need to contact ebay nor the seller regarding this. Simply go to your ebay page where it shows the item purchased. It would be under Purchase History or Orders.

To the right is "more actions" and one of the options is to return the item as shown by the red arrow. From there you will be asked to choose a reason for the return and your choice would be "Doesn't seem authentic".

Keep in mind that on ebay you are NOT required to provide any proof that the item is a fake, but make sure you are certain it IS a fake before proceeding with such a return. Once you have initiated this return, the seller will have 3 days to respond and in most cases they will be required to provide you with a return shipping label at their expense. The seller may try to argue with you about authenticity but if they do not offer an acceptable resolution within the required time frame, you can have ebay escalate the case. No matter what, if it's fake and within 30 days of receiving, you WILL get your money back, and the seller is unable to fight that.

VERY IMPORTANT: Any time you are returning an item for a refund, protect yourself by using a shipping service with tracking. If you cannot prove the item was returned, and the seller claims they never received it, you will have a very difficult time getting your refund.

Now in the case of the ebay counterfeit selling network that is mentioned on my sellers to avoid page, they will persist and insist that what they are selling is genuine. They will offer to show receipts (fake of course) and a video of one of their codes registering back before Moncler disabled them. They have all kinds of excuses as to why the codes don't register but they are all lies.

VERY IMPORTANT!!! While the case is open with ebay, DON'T open a case with PayPal as well. Doing so will close your case in ebay and you will have to rely on help only from PayPal.

ebay's policy regarding items "not as described" trumps any seller's "terms of service" regarding returns and refunds so don't be concerned if the seller's listing states that they do not take returns. They will be required to take it back if it's a fake.

If the purchase was made more than 30 days ago but less than 180 days ago, and paid with PayPal, you can open a case through them. In this case they may ask for proof that it's a fake if the seller disputes your claim. This can be obtained from Moncler by going through the proper steps outlined HERE. A screen shot of an email from Moncler stating that the jacket is fake is all PayPal would need.

Whenever possible, you should always pay with a credit card through PayPal for any ebay purchases because it gives you extra protection if ebay and PayPal are unable to help.
Feedback :

Please, please, please leave honest feedback to warn others. When it comes to leaving feedback for a seller who sold you a fake, I always encourage buyers to be honest when the seller has been deceptive. After all, your feedback is important in informing other buyers about a dishonest seller. Right now, many high volume counterfeit sellers are running rampant on ebay because those who bought fakes from them chose to not leave feedback. Never feel guilty about leaving negative feedback for fear of hurting a deceptive seller's reputation. Remember that counterfeit sellers are SCAM ARTISTS and they are in the business to cheat people. They don't feel guilty so why should you?

When leaving feedback, understand that there are rules restricting what you can put in your feedback comment. Do not post links, email addresses, phone numbers, etc. Don't refer to any dispute or case involving ebay or PayPal. Don't call names or make insults. Any of these things will cause your entire feedback comment to be removed by ebay. Simply state your opinion of the seller/transaction, such as: "BEWARE! These are counterfeit Moncler jackets!"

I have recently found out that refunded transactions no longer show up in the list of your purchased items on ebay so if you go to leave feedback for a refunded purchase, you may not have an easy time finding the item. The first thing to do is check the website's return policy regarding counterfeits or items not as described and follow through with the steps required to process a return. Every website is going to be different.

If you purchased from an imposter Moncler website, the seller may not be so cooperative in taking it back for a refund. Many of those items come from China and it's expensive to ship it back there, but a buyer of a fake should not have to pay a high price to return something that was misrepresented. In this case it's best to contact your credit card company right away and open a dispute on the transaction. Your credit card company should be able to work with you to get the seller to pay for the return shipping.
